Specifically, panelists will discuss ethics opinions addressing a lawyer’s obligation to refrain from using “web bugs” to track use of emails sent to opposing counsels. The panel will also discuss the attorney-client privilege, the ABA’s model Upjohn warning language and will compare Rules 4.2 and Rule 4.4 of Professional Responsibility in reference to the skip counsel rule versus the control group rule.
