Principal Diana Manning submitted a brief on behalf of amicus curiae DRI – The Voice of the Defense Bar in the case In Re: Accutane Litigation (A-25-17) (079958). The brief argued that New Jersey’s expert witness standard was in need of clarification and urged the court to join the majority of other states and adopt the Daubert standard to ensure meaningful judicial gatekeeping and that only reliable and reliably applied expert testimony enters New Jersey’s courts. In a unanimous opinion, the New Jersey Supreme Court adopted consideration of the Daubert factors, determining that it would afford clarity in the realm of proffered expert testimony and provide more consistent guidelines for trial courts to follow in exercising their proper “gatekeeping” role, which seeks to disallow generally unreliable, unsound, and unaccepted expert testimony from reaching a jury.
