Overview

Ed Velky focuses his practice on a wide range of legal matters, including business law, complex commercial litigation, construction disputes, employment issues, and general litigation. He represents clients across various industries in cases involving partnership and shareholder disputes, malpractice claims, corporate divorce, breach of contract issues, construction conflicts, employment claims, and other business torts.

Ed is experienced in all phases of litigation, which includes case analysis and strategy, written and electronic discovery, depositions, preparation, motion practice, oral arguments, resolution, trials, and binding and non-binding arbitration. He has successfully prosecuted and defended cases in both state and federal courts. Due to his broad and extensive litigation experience across diverse industries, Ed frequently collaborates with other firm attorneys and practice areas to provide a multidisciplinary approach to each client's legal needs and assist with complex litigation and appellate work.

In addition to his litigation practice, Ed provides counsel to a variety of clients, including closely held businesses, contractors, subcontractors, construction managers, suppliers, and restaurateurs. He also serves as outside General Counsel for a major sports complex and concert venue in the tri-state area, where he handles various matters, including contract negotiation and litigation.

Before joining Bressler, Ed worked at law firms in New Jersey, where he represented individuals and businesses—both small and large—in complex commercial disputes as well as business professionals facing professional malpractice actions. He began his legal career as a Judicial Law Clerk to the Honorable Bruno Mongiardo, J.S.C. in the Passaic Vicinage of the Superior Court of New Jersey, Civil Division.

During law school, Ed interned with the New York Law School Criminal Defense Clinic, where he represented clients charged with misdemeanor offenses. He also served as a legal intern in the criminal division of the New Jersey State Office of the Public Defender, assisting with briefs related to indictment dismissals, illegal seizures, plea bargains, and violations of Miranda rights.

Business Litigation:

  • Achieved a pre-answer dismissal of a federal lawsuit for breach of contract against a construction company and one of its principals.
  • Successfully filed a motion to dismiss on behalf of a legal malpractice client under Federal Rules of Civil Procedure 12(b)(6).
  • Secured a pre-litigation settlement of $1.8 million (full demand) on behalf of a commercial lender.
  • Obtained a judgment exceeding $200,000 for a nutrition and wellness client.
  • Acts as outside General Counsel for a major sports complex and concert venue in the tri-state area.
  • Obtained summary judgment on behalf of a cannabis client in prerogative writs action.

Employment Litigation:

  • Prepared and handled a pre-answer motion to dismiss on behalf of an employer in defense of a former employee's alleged claims under the New Jersey Law Against Discrimination (NJLAD) related to age discrimination.
  • Represented a chiropractic practice concerning misclassification issues under state and federal law regarding a wage dispute.
  • Defended a broker-dealer against a former employee's claims of hostile work environment, retaliation, wrongful termination, defamation, and violations of the Conscientious Employee Protection Act (CEPA).
  • Represented a contractor in a lawsuit filed by an employee who claimed violations of NJLAD based on sex, perceived mental disability, and failure to accommodate. Additionally, counterclaimed on behalf of the contractor for the former employee’s breach of a restrictive covenant.
  • Assisted a cannabis employer with a pre-litigation matter regarding an employee’s claims of failure to receive compensation for work performed, as well as alleged claims of negligence. Moreover, represented the employer concerning the employee's breach of restrictive covenants.
