Overview
Sean M. Whyte is a Principal in our firm’s Commercial Litigation practice group. Sean has special expertise in consumer class actions. He has helped clients in many different industries, including, financial services and manufacturing. Many of Sean’s clients turn to him when trying to navigate new or rapidly changing areas of law such as those impacting distributed-ledger technology (blockchain), cannabis/hemp products, and compostable/recyclable products.
Sean has successfully represented clients in trials in federal and state courts across the United States, as well as drawing on his prior experience as an in-house lawyer to provide non-litigation advice to clients. As a former academic, Sean enjoys learning about his clients’ businesses and finding unique practical and creative solutions to the clients he advises. He received his Bachelors from West Virginia University, his Masters from Bowling Green State University and his J.D. from The University of Texas School of Law.

- Defended Emmitt Smith in litigation involving a restaurant in Las Vegas, Nevada.
- Successfully dismissed several class actions against hemp manufacturers brought in the Central District of California Federal Court.
- Provided advice to London-based distributed-ledger technology company (blockchain) regarding securities regulations related to cryptocurrency exchanges in the United States.
- Provided advice regarding NFTs (non-fungible tokens) for a merger of two technology companies.
- Successfully denied class certification in over a dozen consumer class actions.

Get to Know Sean
Outside of work, Sean enjoys following his alma maters—West Virginia University and the University of Texas—in football and basketball. Sean also has a passion for food that includes cooking and finding new restaurants. Last but certainly not least, Sean loves spending time with his wife Katie (also a lawyer), their two young children (Rory and Patrick), and his adult daughter Alexa who also lives in the Garden State.
