Law360, New York (August 1, 2016, 2:20 PM ET) -- New Jersey courts are not antagonistic to the arbitration of employment disputes. Indeed, they have favored arbitration as a means of resolving disputes.[1] Parties to an agreement may waive statutory remedies in favor of arbitration, but an arbitration clause will not be enforced where its language does not indicate the employee is clearly and expressly waiving his right to a jury trial.
