Earlier this year, both New York and New Jersey passed legislation that legalized adult use cannabis for adults over the age of 21. See S.854-A/A.1248-A: The Marihuana Regulation and Taxation Act (New York cannabis law) and N.J. A21: New Jersey Cannabis Regulatory, Enforcement Assistance and Marketplace Modernization Act (New Jersey cannabis law). While both laws provide a regulatory scheme that includes multiple license types, license restrictions, and social equity provisions there are some differences between them. Notable are the key differences in the ability to home grow and the tax rates on cannabis products.
